SWEEPSTAKES VOID WHERE PROHIBITED BY LAW, RULE OR REGULATION AND OFFERED ONLY IN THE UNITED STATES; AND IS OPEN ONLY TO LEGAL RESIDENTS, AGE 18 OR OLDER, OF THE UNITED STATES, INCLUDING DISTRICT OF COLUMBIA.
THE SPONSOR: The Sweepstakes sponsor is Wella Operations US LLC, located at 4500 Park Granada, Calabasas, CA 91302 (“Sponsor”).
The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook, Twitter, Google, or Pinterest. All inquiries should be directed to Sponsor.
SWEEPSTAKES PERIOD:The Sweepstakes begins at 12:00 a.m. Pacific Standard Time ("PST") on March 1, 2024 and ends at 11:59:59 p.m. PST on March 31, 2024 (the "Sweepstakes Period"). Sponsor's computer is the official time-keeping device for the Sweepstakes.
ELIGIBILITY: Only open to persons with a valid mailing address, E-mail address, and a valid account with the online Wella Professional Store, found at https://us.wella.professionalstore.com/ ((“The Wella Professional Store”) who are legal residents of the 50 United States, including the District of Columbia, who are at least 18 years of age (“Entrants”). This sweepstakes is governed by the laws of the United States. All Federal, state, and local laws and regulations apply. Void where prohibited. Entrants who have not reached the age of majority in their jurisdiction of residence shall require parental consent to participate. Employees/Educators of Sponsor, its subsidiaries, affiliates, distributors, partners, retail dealers, advertising and promotional agencies, and any other individual or entity directly involved with this Sweepstakes, including immediate family members, are not eligible. Immediate family includes parents, children, siblings, and spouses.
HOW TO ENTER:
You may enter by accumulating points through purchases made on The Wella Professional Store, or by mailing entry information directly to Sponsor (Mail-in Entries together with Purchase Entries are collectively, "Entries"). Every 100 points earned during the Sweepstakes Period by either making purchases or submitting mail-in entries is equal to one (1) automatic entry. No combination of purchases or mail-in entries will be eligible for entry or considered as an entry. No purchase necessary to enter. Purchase will not increase your chance of winning. All entry requirements subject to complete Official Rules.
Entry Instructions:
1. To Enter Through Purchase:$1 spent on The Wella Professional Store = 1 point
a. Enter promo code MARCLIMAZON at checkout during the Sweepstakes Period, defined below, to accumulate points. Points will be accumulated on pretax purchase amounts throughout the Sweepstakes Period.
b. You must have a valid account associated with The Professional Store to enter. Each entry will be attributed to the email address used to log in to The Professional Store at the time of purchase.
2. To Enter without Making a Purchase: You may enter without making a purchase by sending a 3" x 5" paper with your complete name, the email address associated with your Professional Store account, mailing address, and date of birth in a hand-addressed, stamped envelope, to: Wella Operations US LLC, located at 4500 Park Granada, Calabasas, CA 91302 ATTN: Lauren Lawson. Mail-in Entries must be mailed separately (one (1) Mail-in Entry per envelope). Mail-in Entries must be postmarked by April 1, 2024 and received by April 8, 2024 to be entered into the Sweepstakes. Mechanically reproduced Mail-in Entries are automatically void. Sponsor is not responsible for lost, late, illegible or postage-due Mail-in Entries.
Any attempt by any Entrant to obtain more than fifteen Entries, regardless of method of Entry, by using multiple/different email addresses, mailing addresses, identities, registrations and logins, or any other methods will void such Entries and that Entrant may be disqualified. Use of any automated or computer system to participate is prohibited and will result in disqualification. Normal Internet access and usage charges imposed by your online service may apply. If entering via mobile device, normal phone/data and usage charges imposed by your phone service may apply. Standard data rates may apply if entering via mobile device. Incomplete, corrupted, or untimely Entries are void and will be disqualified. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen or misdirected Entries; lost, interrupted, or unavailable network, server, or other connections; or miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a user's computer equipment (software or hardware), or other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. Proof of submission will not be deemed to be proof of receipt by Sponsor.
In the event of a dispute as to the identity of an Entrant, the authorized account holder of the email address used to enter will be deemed to be the Entrant or participant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider, or other organization (which may include an employer) responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. Entries specifying an invalid, non-working, or inactive email address will be disqualified and ineligible to win.
PLEASE NOTE THAT ANY FAILURE TO COMPLY WITH THE COMPLETE OFFICIAL RULES MAY DISQUALIFIY AN ENTRANT.
WINNER SELECTION AND NOTIFICATION: The winner will be selected at random by Sponsor from all eligible Entries after the Sweepstakes Period closes. All decisions of the Sponsor will be final and binding. Potential Winner will be notified by email and/or telephone within a reasonable time after the conclusion of the Sweepstakes Period. The Potential Winner may be required to sign and return an Affidavit of Eligibility, Release of Liability and a Publicity Release, as provided by Sponsor, within two (2) days of attempted delivery or prize may be forfeited and an alternate winner may be selected from remaining eligible entries, at Sponsor's sole discretion. If, despite reasonable efforts, a potential winner does not respond within the time period specified in the prize notification, or if a prize or prize notification is returned as unclaimed or undeliverable to such potential winner, or if an Affidavit of Eligibility is returned undeliverable, or in the event that a potential winner is determined to be ineligible for any reason or has not complied with these Complete Official Rules such potential winner will forfeit the prize and an alternate winner may be selected, time permitting, at Sponsor’s sole discretion. The return of any prize/prize notification as undeliverable will result in disqualification and an alternate winner may be selected from remaining eligible entries, time permitting. If a potential winner is found to be ineligible, or if a potential winner has not complied with these Complete Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected, time permitting. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason.
An Entrant is not deemed a Winner of any prize, even if the winning notification should so indicate, unless and until the entrant's eligibility has been verified, all required documents returned and executed, and the entrant has been notified that the acceptance and verification process is complete. Odds of winning a prize will be determined by the total number of eligible Sweepstakes entries received. The winner will be announced on or about April 15, 2024.

Total Approximate Retail Value of the Prize (“ARV”): $1,800.00 U.S. Dollars
If a potential prize winner is unable to meet the aforementioned requirements, he/she/they must forfeit the prize and an alternate winner will be selected. Sponsor shall have no responsibility or obligation to any winner or potential winner who is unable or unavailable to accept or utilize prizes as described herein.
The prize is not transferable or substitutable and must be accepted as awarded. In the event any element of any prize becomes unavailable for any reason beyond the reasonable control of Sponsor, Sponsor shall provide a substitute prize in its sole discretion. The winner is solely responsible for all applicable income taxes on the prize.
CONDITIONS AND LIMITATIONS
The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook, Twitter, Google, or Pinterest. No cash equivalent for any prize is offered, except at the sole discretion of the Sponsor. Sponsor is not responsible for any entries that are late or not received. Sponsor may in its sole discretion suspend, modify or discontinue this Sweepstakes at any time. Should the Sweepstakes be terminated prior to the stated expiration, notice will be posted. In no event shall more prizes be awarded than the number of each type stated in the “Winner Selection and Notification” section above. If legitimately claimed, the stated prize will be awarded.
Submitting an entry constitutes your consent, and, to the extent applicable, the consent of the content in your review, to give Sponsor, and Sponsor’s affiliates and designees, a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display your entry in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, you will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the entry. Entry into the Sweepstakes constitutes your agreement and consent (or the consent and agreement of your parent/legal guardian if you are deemed a minor in the jurisdiction of your residence) that Sponsor and its designees may use your name, city, state, likeness, photo, biographical and/or prize information in connection with the Sweepstakes for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including television, radio, mobile media and the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law. Sponsor is not obligated to engage in any of the foregoing uses.
Subject to applicable privacy laws, all entry information collected may be used for the Sponsor's internal purposes and to send you information about Sponsor’s products/ promotions (you may opt out by following the instructions at the bottom of any promotional email you receive from Sponsor) but will not be provided or sold to third parties, except as necessary for the administration of the Sweepstakes or legal procedure. By entering, entrants agree to these Official Rules and Sponsor’s Privacy Policy. All decisions of the Sponsor will be final and binding. This Sweepstakes is subject to all applicable laws and regulations. Sponsor and its agents, affiliates and advertising and promotion agencies (a) make no warranty, guaranty or representation of any kind outside those written in these Official Rules, (b) disclaim any implied warranty and condition; and (c) are not in any way responsible or liable for damage, loss or injury resulting from acceptance and use of a prize. Winner assumes liability for costs, expenses, injuries and/or damages of any kind caused or claimed to be caused by participating in the Sweepstakes, or by the acceptance, possession or use of any prize. By entering, all entrants (or entrant’s parent/legal guardian if any entrant is deemed a minor in their state of residence) agree to release, indemnify and hold harmless Sponsor, and its agents, affiliates and advertising and promotion agencies, as well as Instagram, Facebook, Twitter, Google, or Pinterest, from any claim, injury, damage, liability or loss that may arise, directly or indirectly, in whole or in part, from the participation in this Sweepstakes, including without limitation, third-party intellectual party claims arising out of or relating to any entry and/or from the acceptance, receipt and/or use of any prize.
BY PARTICIPATING, TO THE EXTENT PERMITTED BY APPLICABLE LAW, ENTRANTS AND THE WINNER AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, THEIR PROMOTIONAL PARTNERS, AND THEIR ADVERTISING AND PROMOTIONS AGENCIES, CONTENT PROVIDERS, PRODUCERS AND DISTRIBUTORS OF CONTENT AND EACH OF THEIR RESPECTIVE PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS AND DIRECTORS (COLLECTIVELY, “RELEASED ENTITIES”), FROM ANY AND ALL LIABILITY, FOR LOSS, HARM, DAMAGE, INJURY, COST OR EXPENSE WHATSOEVER INCLUDING WITHOUT LIMITATION, PROPERTY DAMAGE, PERSONAL INJURY AND/OR DEATH WHICH MAY OCCUR IN CONNECTION WITH, PREPARATION FOR, TRAVEL TO, OR PARTICIPATION IN SWEEPSTAKES, OR POSSESSION, ACCEPTANCE AND/OR USE OR MISUSE OF PRIZE OR PARTICIPATION IN ANY SWEEPSTAKES-RELATED ACTIVITY AND FOR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, INVASION OF PRIVACY, COPYRIGHT INFRINGEMENT, TRADEMARK INFRINGEMENT OR ANY OTHER INTELLECTUAL PROPERTY-RELATED CAUSE OF ACTION. Participation in Sweepstakes and acceptance of prize constitutes the winner’s permission for Sponsor to use his/her/their name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information, and/or any statements made by each winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. Entrants who do not comply with these Official Rules, or attempt to interfere with this Sweepstakes in any way shall be disqualified. Entrants acknowledge and agree that their participation in this Sweepstakes are not and do not create any confidential, fiduciary, employment, agency or other special relationship between entrant and Sponsor. Sponsor is not responsible in any manner if Sweepstakes cannot take place, or if any prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, public health crises, epidemics, pandemics, travel restrictions, government restrictions or bans, acts of public authorities, weather or acts of terrorism.
ADDITIONAL TERMS. Any attempted form of entry other than as set forth above is prohibited; no automatic, programmed, robotic or similar means of entry are permitted. To the extent permitted by applicable law, Sponsor, its affiliates, partners and promotion and advertising agencies are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Sweepstakes, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes. All incomplete or non-conforming entries and their entrants will be disqualified. Sponsor is not responsible for incorrect or inaccurate entry information caused by human error which may occur in the receipt or processing of the Entries; or for any errors, misprints or typographical mistakes in any advertising of the Sweepstakes or prize notification. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its reasonable control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes and/or as a result of any applicable law, regulation, decree or guideline, or for any reason at all, in Sponsor’s sole discretion. In such case, Sponsor may select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right to cancel or modify this Sweepstakes (including by not awarding the stated prize) in the event an insufficient number of entries are received. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or web site. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT AND RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
LIMITATION OF LIABILITY; DISCLAIMER OF WARRANTIES: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE ANY WEBSITES ASSOCIATED WITH THIS SWEEPSTAKES, OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING, THIS SWEEPSTAKES AND THE PRIZE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW (I) THE EXCLUSION OF IMPLIED WARRANTIES ON APPLICABLE STATUTORY RIGHTS, SO THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY IN SOME CASES. DISPUTES; GOVERNING LAW: The parties (“Entrant and Sponsor”) waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or the Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of California, City of Los Angeles.
THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF CALIFORNIA WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Sweepstakes, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to Los Angeles County in the State of California. The parties agree not to raise the defense of forum non conveniens.
USE OF DATA. Sponsor will be collecting personal data about Entrants online, in accordance with their privacy policy. Please review the privacy policy at https://www.wellacompany.com/privacy-policy. By participating in the Sweepstakes, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted the privacy policy. In addition, anyone who opts in to receive marketing emails from Sponsor will be added to Sponsor’s marketing list. Their details are kept on the list until the user unsubscribes from receiving email marketing from Sponsor. Users can unsubscribe from emails from Wella Brands at any time using the unsubscribe links in marketing emails or by clicking here. Wella Operations US LLC (‘Wella’) will use name and email address of data subjects to reach out to the winner to inform them that they have won specific prize(s) and will ask for their postal address to mail them their prize. In addition, we may need to issue a 1099 tax form to the winner. To do that, we may need a winner’s social security number and a copy of a government issued ID. If necessary, Wella will retain this information for 120 days from the drawing of the winner. ENTRANT FURTHER ACKNOWLEDGES THAT IF ENTRANT IS CHOSEN AS A WINNER, ENTRANT’S IDENTIFYING INFORMATION, INCLUDING BUT NOT LIMITED TO ENTRANT’S NAME AND STATE OF RESIDENCE, MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, BEING PLACED ON A WINNERS’ LIST.
